The owner entered into a PSA with Flywheel Capital on February 1, 2019, and the owner listed the property on the Thornton Development Authority website on July 8, 2018, with the understanding that Fly Wheel and its partners remain interested. The City of Thornton has drafted Jay Brown's letter about the Thornton Shopping Centre on July 8, 2020 for consideration and review by the board of directors of the South Thornton Urban Renewal Area regarding its ownership. On 9 July 2017, the Thornton Development Authority, at the request of the city, reached an agreement to upgrade the destroyed properties in the North Thornton and SouthThor Thornton urban regeneration areas, including the Thornton shopping centre. Fly Wheel has completed extensive due diligence that will allow the development of a multi-million dollar commercial property in Thornton, depending on the technology used and the desired results.
The city had been trying for years to work with Brown to sell the property for redevelopment, he said. A few years ago, Cody said, they created a commercial property maintenance law to solve the problems at Thornton Shopping Center.
The city of Thornton sued Brown in court, imposing fines for violations and a $1,000 fine for each violation and $500 for each violation.
The court ordered the defense to file a motion within ten days to justify its motion to dismiss Jay Brown. The next step is for the court to schedule a sentencing hearing and listen to the contributions of the city, the defendant and the public to decide on an appropriate sentence. That penalty can include a fine of up to $1,000 for each violation and a maximum penalty of five years in prison. Once the courts decide on the motion, Thornton LLC will put the case on hold for trial and enter a guilty or not guilty plea (except for a surprise request for deferral), with the plea being "not guilty."
In 2018, ERO consultants were asked to evaluate Thornton LLC's corrective action plan, provide cost estimates for cleanup and demolition work, and read the report here. One of the most important findings of this study is a comprehensive map of groundwater contamination, which can be viewed here, as well as a detailed report on the city's response to the contamination. Staff will produce the final report of the City of Thornton's environmental impact report by the end of May 2020.
The city's property maintenance officer is continuing to work with the city's attorney's office to prepare the next court date for numerous open violations. The next hearing will be a procedural hearing, where the court will rule on a motion to dismiss Jay Brown. Also listed below, in addition to the status of enforcement of the Code, are documents related to the city's efforts to bring the property into compliance with the city code (see paragraphs 5 and 6). This is the latest in a series of updates to the city of Thornton's ongoing property enforcement efforts.
The Thornton City Office of Real Estate Entertainment and the Thornton Police Department are holding a public hearing on Jay Brown's lawsuit against the city for violating city law.
The city has contacted CDPHE to discuss a suitable plan to drive forward the development of a multi-million dollar retail development on the site.
